50% of Surgical Errors Avoidable:
Some Researchers believe that as many as 50% or more of surgical errors could be avoided. There are plenty of excellent surgeons practicing medicine and at the same time, there are quite a few of incompetent surgeons.
Most people trust physicians and surgeons inherently, and never question how surgical mistakes happen.
The reality is that medical mistakes happen because surgeons are human and have weaknesses, and make mistakes just the same as everybody else. Many surgeons make mistakes because of inexperience or improper training.
May non-qualified surgeons are now attempting plastic surgery and/or cosmetic surgery with horrific results to patients.
One of the problems is that a physician can try almost any surgery if the patient allows them. An orthopedic surgeon can try brain surgery one day. A dermatologist can try plastic surgery. There are few restrictions on surgeons if the receive consent and want to try new procedures.
If you are having any kind of surgery, be sure to research your doctor and ask the important questions prior to agreeing to the surgery. There are many things you can do to ensure that the surgeon you pick is qualified to perform the procedure chosen:
- Check Board Certification: (Are they a board certified plastic surgeon?)
- Check Accreditation: (Is this an accredited surgery center?)
- Check Hospital Privileges (do hospitals allow this doctor to perform this surgery?)
- Check References: (Ask other doctors about him/her)
- Verify his/her Experience: (research your physician on line)
A bad outcome or a complication does not always indicate that there was a deviation from the acceptable standard of care or that a lawsuit exists. Only have your case reviewed by competent medical malpractice attorneys and competent experts, will you know if the result warrants and merits legal action.
The medical malpractice attorneys of FLAHERTY FARDO are skilled in reviewing medical cases involving surgical errors in:
- General Surgery
- Orthopedic Surgery
- Heart Surgery
- Cardiovascular Surgery
- Laparoscopic Surgery
- Plastic & Cosmetic Surgeries
- Brain Surgery
- Abdominal Surgery
We also have the advantage of having physicians on retainer to help review cases to ensure the best representation for our clients.
The Advantage of Having Physicians on Retainer:
FLAHERTY FARDO, LLC has a distinct advantage over many other law firms by having immediate and unfettered access to board certified physicians to review cases and to help with the prosecution of medical malpractice actions when negligence exists.
Our law firm is proud to have both Dr. Barbara Fardo, D.O. and Dr. Dean Fardo, on retainer to fully evaluate our potential medical malpractice cases. Both Dr. Fardo’s are board certified and operate their own medical practices respectively. Combining the trial experience of our law firm, with the expertise of our physicians, we believe gives us the greatest opportunity to maximize monetary recovery for our injured clients.
Pennsylvania Requires ‘The Certificate of Merit’:
In 2003, the Pennsylvania State Supreme Court approved a new rule requiring attorneys to obtain a “certificate of merit” from a medical professional establishing that the medical work in the case fell outside acceptable standards. A lawyer failing to obtain the certificate cannot bring a case to trial. Therefore, it is imperative that medical malpractice claims are investigated by competent attorneys who have immediate access to a variety of expert physicians for review.
