Summary of case:

A 34 year old female sought a breast reduction for health related reasons. We alleged that during the medical procedure, the physician combined an excessive amount of liposuction with an excessive amount of excision (or cutting of the skin). We alleged that the combination of the activities led to an inadequate amount of blood supply and ultimately to a serious infection which required complete re-constructive surgery of both breasts. The case settled for more than a million dollars shortly after the complaint in civil action was filed. We believe our thorough investigation and knowledge of the facts led to the successful settlement.


  • Confidential settlement for victim of trucking accident.

Summary of case:

A father and his son were travelling back from visiting family while travelling on the Pennsylvania Turnpike. We alleged that a tractor trailer driver, was not only speeding, but was also intentionally violating the Federal Hours of Service Regulations when a violent accident occurred. Truck drivers are limited as to the number of hours that they can drive both daily and weekly to prevent driver fatigue. We spent several years researching more than 10,000 documents which we believed established a pattern by the trucking company of this exact kind of conduct. As a direct result, we demanded punitive damages. We represented the son who suffered serious injuries. The case was resolved with a multi-million dollar settlement prior to being placed for trial.


  • Confidential settlement for victim of Botched Plastic Surgery involving Awake Breast Augmentation.

Summary of Case:

In June 2010, Managing Partner Noah Paul Fardo obtained a six figure settlement for a victim of a botched plastic surgery case involving an awake breast augmentation. Awake breast augmentation is a growing trend throughout the United States whereby many non-plastic surgeons are attempting breast augmentations with horrific results. There are no requirements that a physician be a plastic surgeon in order to attempt a breast augmentation. As a result, many eye doctors, obstetricians / gynecologists (OB/GYN’s), and even dermatologists are attempting plastic surgery in their offices.   • Confidential settlement for OB/GYN error and mistake.

We helped a 44 year old female obtain a substantial recovery for a case alleging a perforated uterus and bowel were the direct result of a negligent D&C (dilatation and curettage). The D stands for dilation, which means enlarging. Curettage (the C) means scraping. Together, this procedure involves expanding or enlarging the entrance of a woman’s uterus so that a thin, sharp instrument can scrape or suction away the lining of the uterus and take tissue samples. The defendant’s claimed the perforations were a standard risk of the procedure. After discovery was exchanged, we successfully resolved the case for a confidential six-figure settlement.


  • Confidential settlement against Public Utility Company.

We helped the family of an elderly man who died after his heat was shut off in late April of that calendar year. The gas company claimed that they were allowed to shut off the gas because of the delinquent nature of the bill and the amount of money owed on the outstanding bill. Through discovery, we alleged violations of the Public Utility Code which specifically protected elderly in these types of circumstances. The matter quickly resolved with a confidential settlement.


  • Confidential Wrongful Death settlement.

We represented the family of a mental health patient who had a condition known as polydipsia. Polydipsia is a medical symptom in which the patient displays excessive thirst. In our case, the psychiatric institution was specifically instructed to monitor the water intake of our client who suffered from polydipsia. When our client was found dead on his floor, we brought a Pennsylvania wrongful death action on behalf of the family of our client. An autopsy was ordered, which confirmed large volumes of liquids in our clients lungs at the time of death. Also, we analyzed substantial medical records confirming that our client was seen next to a water cooler holding a cup of water, and not being monitored as directed. After a deposition was taken of the attending physician, we settled the case for a confidential amount.


  • Confidential settlement of medical malpractice involving botched plastic surgery.

We settled a case for a female from out of state who visited a Pittsburgh plastic surgeon to have various procedures performed including a breast lift. What made the case unique is that we alleged that the doctor did additional procedures without the patients consent, and as a result, this constituted an assault and battery under Pennsylvania law. The Defendants contended that the procedure was beneficial for the patient. The matter was resolved after the exchange of discovery for a confidential amount.


  • Jury verdict against Allegheny County Port Authority for violation of the ADA.

We obtained the first jury verdict of its kind against the Port Authority of Allegheny County when we proved that the Pittsburgh busing company intentionally discriminated against a paraplegic in strict violation of the Americans with Disabilities Act (ADA) Section II. Specifically, we proved that the busing company allowed buses with inoperable wheel-chair lifts to be placed into service even though other buses were available and functioning properly. After the jury verdict in favor of our client, the Port Authority then lost appeals to both the Commonwealth Court of Pennsylvania and Pennsylvania Supreme Court. It is believed to be the first and only verdict against the port Authority alleging these intentional claims. The case received attention from lawyers and scholars nationwide.
